Eminem sues Apple over iTunes ad

Eight Mile Style, the music publisher for Eminem, filed suit late last week against Apple claiming it used one of Eminem's songs in a television advertisement without permission, the Associated Press reports. The ad in question was one of the first launched for the iTunes Music Store, and featured a 10-year-old singing "Lose Yourself." The ad initially aired on MTV in July 2003. "Eminem has never nationally endorsed any commercial products and ... even if he were interested in endorsing a product, any endorsement deal would require a significant amount of money, possibly in excess of $10 million."

The 15-page lawsuit filed Friday in U.S. District Court in Detroit claims that Apple CEO Steve Jobs phoned the manager of Eight Mile Style and asked Eminem to rethink his position, to which Eminem responded by ending talks with Apple.

Eminem's music label has agreed to an undisclosed financial settlement with Apple in a lawsuit over copyright infringement claims. In February of 2004, Eight Mile Style, Eminem's music label, filed a lawsuit in U.S. District Court in Detroit against MTV, Apple, MTV's parent Viacom Inc. and advertising agency TBWA/Chiat/Day, claiming that Apple used one of his hit songs in an advertisement without permission, according to The Associated Press: "The parties were able to reach an amicable resolution," Howard Hertz, a lawyer for Eight Mile Style and Eminem, while Elizabeth McNamara, a lawyer for MTV and Viacom, said Monday that the case was "amicably resolved." However, all parties declined to provide any further comment.

Apple has apparently pulled its new iPod commercial featuring rap star Eminem. No reason was given for the withdrawal. The 30-second spot premiered today during Apple CEO Steve Jobs' keynote speech at an Apple special event. The ad features Eminem performing his hit single "Lose Yourself" and was expected to begin airing on television in a week. The commercial takes a new 3D approach to the "silhouette" effect popularized by other iTunes ads. Apple had worked on the ad for over two years, according to Mr. Jobs. "It takes our silhouette campaign up to a whole new level," Jobs said. The ad was well-received by the audience at the keynote, and Jobs even played it twice.
