Default Jan 20 - 50 Cent Sued for Copyright Infringement

MIAMI - Rapper 50 Cent stole some of the lyrics for his 2003 hit "In Da Club" from a song by former 2 Live Crew frontman Luther Campbell, an attorney claims in a lawsuit.

Richard C. Wolfe filed the copyright infringement lawsuit against
Curtis James Jackson, aka 50 Cent, in Miami federal court last week on behalf of Lil' Joe Wein Music.

Parts of "In Da Club," from the album "Get Rich or Die Tryin'", copy "It's Your Birthday," released in 1994 on Campbell's solo album "Still a Freak for Life," the lawsuit alleged.

A message left Friday for Wolfe was not immediately returned.

Lil' Joe Wein Music holds the copyright to "It's Your Birthday" and other songs Campbell produced with his rap group 2 Live Crew and as a solo artist. Lil' Joe Wein Music is owned by Joseph Weinberger, an attorney who formerly represented Campbell.

Campbell's song "I Like It, I love It" can also be heard on the 2003 DVD "50 Cent The New Breed," the lawsuit claims.

The lawsuit seeks unspecified damages in addition to attorneys' fees and other legal costs.

Wolfe won a $2.3 million judgment against Campbell in 1994 for another rapper who claimed Campbell withheld royalties.

A message left Friday for Dennis Dennehy, 50 Cent's publicist, was not immediately returned.

Correction: A headline on the Yahoo! home page incorrectly said that Luther Campbell had sued 50 Cent. In fact, as the article correctly stated, the suit was not brought on behalf of Campbell but rather on the behalf of a company that owns the copyright to the disputed song. Yahoo! regrets the error.

Nearly three years after his hit In Da Club rocketed up the charts, rapper 50 Cent is being sued for copyright infringement over the song.

Lawyer Richard C. Wolfe has filed a lawsuit against the hit rapper and Universal Music in Miami federal court on behalf of record label Lil' Joe Wein Music.

The suit alleges that Curtis James Jackson (a.k.a. 50 Cent) lifted some of his lyrics for In Da Club from a 1994 song entitled It's Your Birthday by 2 Live Crew founder and rap entrepreneur Luther Campbell.

The oft-repeated intro to In Da Club includes the lines: "Go shorty, it's your birthday. We're gonna party like it's your birthday."

It's Your Birthday includes the lines: "Go Freddie! Go! Go! Go Freddie! Go! Go! Go Freddie! It's your birthday. It's your birthday. It's your birthday."

The lawsuit, filed last week, seeks unspecified damages, lawyers' fees and other costs.

Lil' Joe Wein Music owns the copyright to It's Your Birthday and other songs from Campbell's catalog, both as a member of 2 Live Crew and as a solo artist.

The label is owned by Joseph Weinberger, a lawyer who formerly represented Campbell. Weinberger struck a deal to buy the rights to Campbell's music when the early rap artist declared bankruptcy in the mid-1990s.

Wolfe, who filed the lawsuit last week, is also the lawyer who opposed Campbell in a separate lawsuit in 1994. He represented a rapper named Peter Jones, who sued Campbell for withholding royalties over a record Campbell produced.

Jones eventually won a $2.3-million US judgment against Campbell, who subsequently was forced to file for bankruptcy.
